Criminal History Requirements for Seattle Employers

As of November 1, 2013, Seattle employers will follow new compliance requirements when using criminal history information during the employment screening process. Seattle Municipal code, Chapter 14.17, Ordinance 124201 was approved in June and states that Seattle employers must do the following:

– Consider all job applicants prior to conducting a criminal background check,

– Conduct an individual assessment considering the position, and applicant if the criminal history (arrest or conviction) may impact the ability of the applicant to obtain a position,

– Maintain a job opening for at least two business days if a criminal history search adversely affects the applicant.

Although there are exceptions, an employee may benefit from these changes even if he/she works at least half of the time within the Seattle city limits.
